Laguna Woods Village, CA -Whether the United Board recall is absolutely necessary is debatable. What is not debatable is the Golden Rain Foundations board’s behavior during the June 2, 2009. When all residents wanted was a little respect, board president Erwin Stuller resorted to unnecessary defamatory and personal attacks. What is more appalling is that the rest of the board failed to step in and apply a modicum of decorum to the proceedings. Such behavior is not only despicable but calls for an apology and stepping down. The video clip capturing Mr. Stullers less than despicable behavior during the proceedings are quickly becoming a rallying cry against abusive HOA directors.
Also not debatable is that GRF Board Director Hatch’s hatched proposal to bilk residents of a $5,000 a transfer fee to sell their property is not being taken too kindly:
“This is ridiculous, in this real estate market, Wendy Bucknum wants
$5,000.00 from SELLER, I paid $2,500.00 transfer fee to buy into L.W.
We are not needing any new buildings - we are bilt out, GRF Reserves
are at $34,000,000.00?? Not another dime for RESERVES GRF! If
I sell why would I want to give $5,000,00 for GRF Reserves????

Recall - Arguments for and Against
Mr. Curtis’ is not known for mincing words, and he does not disappoint this time. He writes:
1) we want our money back from PCM. PCM admitted, in writing, they secretly took between $250,000 and $1,000,000+ per year between 1996 and 2007 with no knowledge or approval of the boards. this is the truth - or they would have had me in court long ago!
2) we want 2010 assessments down and the PCM “make work” projects to stop. so far, 2010 will still be higher (United up $4.38, GRF up $3.23). for uUnited, we’ll be paying $6.59 per month for unnecessary replacement of a 1,700-foot concrete block wall, $2.19 per month for Linda Wilson’s make work “turf reduction” project, and $2.10 per month for other increases. these extra costs could all be avoided, with no threat to the quality or appearance of our community.
The arguments used by the United Board opposed to the recall range from the “10,000 flies argument” to simply attacking the messenger. Along the way, the opponents have earned a Cease and Desist reprimand from Mr. Curtis’ attorney. Directors Marv Rosenhaft and Marty Ruben, for example produced a flier “..calling for a clear, democratic and inclusive election”, while apparently disregarding statue. “As a Director (really anyone, including PCM), you cannot use resources of the community, including petition signatures and their personal information, to interfere or tamper with the will of the petitioners, in an effort to stop this recall (ref Civ Code 798.50-52)”, responds Mr. Curtis.
Straight shooter Lou Skogen of the PCM’s temporary restraining order fame shoots the arrow straight at Mr. Rosenhaft’s argument:
“Poor dear Marv,
What kind of cockamanie stories you are concocting. Was Milt Johns your mentor? It sure sounds like it.
You claim that you board members are working hard. Working hard at what? You side with PCM on every issue that comes up, and damn the residents.
We residents are sick and tired of that garbage. Moreover, you irritate the heck out of all of us by voting in favor of all the increases PCM proposes for the 2010 budget. Increases to charges that are already out of sight.
Answer me this question: Who in their right mind would pay $41 an hour to have lawn mowed?
You guys all voted for this. And word is spreading around the community. Why are 4 of you being recalled?? That’s one of the biggest reasons. You have no care for our pocketbooks.
You are continuously dumping on Mike Curtis is another reason people are sick of you.
Save your breath, save your time. Four of you will be out”

The Uncommon Denominator
We previously made the argument that common interest development/homeowners associations (CID/HOA), are characterized by a group of vocal residents usually referred to as disgruntled residents. This is the first time however that we see a service provider dictate to the boards what can and cannot be done. Further, the uncommon denominator is that PCM, the service provider apparently not only has uber-sensitive employees, but is also dictating the terms of engagement: Consider the Ultimatum delivered to the Third Mutual board, demanding an apology to PCM employees, the restraining order against a 73-year old resident, and now complaints against PCM’s number one critic. Not to mention a controversial incentive plan, which Mr. Curtis has been actively pursuing.
To Recall or not to Recall
Ultimately United Mutual residents will decide whether the Board and PCM have more credibility than Mr. Curtis and his supporters, and will recall or not recall the board. What is not debatable is that GRF president Erwing Stuller and the rest of the GRF board are worthy recipients of the HOA Directors Hall of Shame.
